Job Function
The EPCA has the responsibility to lead and manage the commercial aspects of the EPC contract development process. Values typically range from $150M to $700M per contract. The activities generally conclude with EPC contract award. The EPCA is provided as functional support to the projects and often handles contracts. The EPCA may follow the contract, post award, by assuming the Contract Administration role in the contractor's engineering office and fabrication yard.
Specific Job Responsibilities:
1. Work with the PCM on the overall project contracting strategy.
- Provide input to PCM regarding potential market impacts on strategy.
- Gain alignment with PCM and PMT regarding timing of contracting activities.
2. Gain alignment with the PMT on specific issues regarding the contract plan for the EPC package being worked.
- Develop summary of key contractual issues and review/agree with PMT as to the Project's position. These include levels of indemnity, warranty provisions, etc.
- Similarly agree with PMT on execution related issues such as schedule enforcement (e.g., Liquidated damages/incentives, weather delay responsibility, etc.)
- Ensure the PMT is familiar with the overall ITT, contract structure, compensation strategy, etc., and establish responsibility matrix assigning personnel and timing for specific ITT components.
3. Coordinate tenderer pre-qualification and selection process.
- With input from PMT, develop a pre-qualification questionnaire to gather data on potential tenderers regarding financial condition, technical capabilities and engineering & fabrication capacities.
- Coordinate questionnaires to potential tenderers.
- Document the review and assessment process that generates the final list of tenderers.
- Assist in obtaining required approval from partners.
4. Develop and obtain approval of the procurement plan.
- Develop, based on the overall contracting strategy, the specific procurement plan for the EPC package being worked.
- Conduct reviews consistent with Delegation of Authority Guidelines to obtain approval.
- Assist in obtaining required approval from partners.
5. Work with the PMT to develop the Invitation to Tender (ITT) package.
- Consistent with the responsibility matrix established with PMT, develop the ITT package.
- Work with the PMT to understand the scope of work to ensure consistency with the compensation model and other information that will be requested from the tenderers.
- Work with the Sealed Bid Administrator to ensure ITT package is complete and consistent with the timing established in the procurement plan.
6. Coordinate communications with tenderers during the tender period.
- Serve as the point contact for all questions and clarifications (technical & commercial) to and from tenderers and tender evaluation team.
- Maintain a database of all correspondence to ensure all questions and clarifications have been properly documented, and issues covered are reflected in the final tender.
7. Analyze proposals and negotiate with tenderer(s) to resolve all contractual terms and conditions and pricing issues during the tender evaluation period.
- Perform analysis of commercial proposal and provide an evaluation of the pricing provided by the tenderers.
- Finalize negotiations of any contested contractual terms and conditions.
- Ensure that the commercial impact of any contractual or technical/execution issues that are resolved/changed during the evaluation period are accurately reflected in the final price.
- Obtain final functional review of all contract documents (e.g. Law, Audit, Controllers, etc.)
8. Work with the PMT to develop and gain approval for the contract award recommendation.
- Provide pricing and other commercial analysis to PMT to participate in development of the contract award recommendation.
- Develop potential alternate cases that are required to support the recommendation.
9. Complete the contract and issue for execution.
- Complete all contractual documents consistent with selected tenderer's proposal, subsequent clarifications and final negotiations.
- Ensure all documents and exhibits to be prepared by other functions are complete and included in final contract package.
10. Maintain communication with UPP Subject Matter Expert and contribute to functional excellence and Network
- Stay abreast of updates to the Sourcing Handbook, major Capital Projects Supplement to the Sourcing Handbook, Procurement DOAG and other procurement specific requirements
- Participate in functional sponsored/required training, matrix meetings, and other Procurement events.
- Actively engage in assigned UPP Network
- Assist in development of tools for Network
Qualifications:
REQUIRED QUALIFICATIONS:
• 10 years of Procurement experience
• Intermediate to Expert Contracting Skills
• Experience in Construction, Maintenance, Drilling, or Production Services Contracting
• Detailed knowledge and application of ExxonMobil requirements (e.g. DOAG, SHB)
• Strong analytical, negotiation and communication skills
• BA/BS Preferred
• Upstream experience would be very beneficial but not required
